Footway Usage Application Process for outdoor dining

Applicants need to apply for a Footway Usage (outdoor dining) approval for footway dining. Licensed premises will be subject to a trial period if approval is granted.

The approval depends on the primary use of the adjoining premises (e.g. restaurant, café, hotel or bar) and the type of land on which the section will be located (e.g. footway, community land or Crown land).

Development consent

In some cases, the applicant will need to submit a Development application (DA) and a Footway Usage (outdoor dining) application. Please consult the Footway Usage map below to see if you require development consent to use the footpath or contact the City of Sydney on 02 9265 9333.

If you must lodge a DA, refer to the Development Applications Guide to assist with filling out your application. You are encouraged to also submit both your applications together to minimise processing time. 

Footway usage approval

In all circumstances applicants will need to submit a Footway Usage (outdoor dining) application and obtain approval.
