Draft Planning Agreement: 32-38 Flinders Street , DARLINGHURST NSW 2010

The City of Sydney proposes to enter into a Planning Agreement relating to the Development Application D/2007/2137.

The objectives of the draft Planning Agreement is to secure public benefits in connection with Development Application D/2007/2137 for a 6 level purely residential scheme comprising 13 x residential units (3 x 1 - bed and 10 x 2-bed) with 11 x basement parking spaces. The proposal involves setting the building back approximately 6 metres from the flinders street frontage to enable the retention of 3 x existing street trees at 32-38 Flinders Street, Darlinghurst, which involves the application of bonus Floor Space Ratio (FSR).

The nature of the draft Planning Agreement is to secure a monetary contribution which the City intends to use for the purposes if the provision of road re-sheeting works in Hill Street, Darlinghurst as part of the road improvement program 2009/2010. This involves payment of $79,820.

The draft Agreement will promote the public interest in terms of providing a monetary contribution towards the funding of infrastructure in the general vicinity of the site.

The monetary contribution will help meet object (a) (v) of the Environmental Planning and Assessment Act 1979 in that it will encourage the provision and co-ordination of community  services and facilities.

The draft Agreement promotes the following two elements of the Council’s Charter:

  1. (a)   the monetary contribution provides adequate, equitable and appropriate facilities for the community and ensures that those services and facilities are managed efficiently and effectively.
  2. (b)   The upgrade of the area in the vicinity of the site will help properly develop, protect, restore, enhance and conserve the environment of the area in a manner that is consistent with and promotes the principles of sustainable development.

The draft Agreement will serve to enhance public domain and infrastructure improvements in the general vicinity of the site.

The draft Agreement does not form part of Council’s capital works program.
